Article 2.2 The User agrees to these Terms once during account registration via the App or Website by accepting them in the “Accept Terms” section, which includes a link to the Terms. This agreement applies to all future rentals. The Terms are available in Dutch and optionally in English via the App and Website (https://iccxx.nl/algemenevoorwaarden).

Article 2.3 ICCXX reserves the right to amend these Terms. Amended Terms will be published via the App, the Website (https://iccxx.nl), or through in-app notifications. Users will be informed of changes via the App or Website.

Article 2.4 Deviations from these Terms are only valid if agreed upon in writing between ICCXX and the User.

3. Rental Process

Article 3.1To execute a rental transaction, the User, after accepting the Terms during account registration, scans a QR code on an ICCXX hub to access the App/Website. If not yet registered, the User creates an account via Apple, Google, or email, requiring a one-time setup of less than 30 seconds.

Subsequently, the User pays a refundable deposit and rental fees per rental transaction via contactless payment methods, as described in Article 4.

Article 3.2 Upon successful payment of the deposit and rental fees, the hub releases a power bank within 5 seconds as part of the rental transaction, for a maximum rental period of 24 hours. The power bank is equipped with USB-C and Lightning cables and is capable of charging a device to 60% in 30 minutes.

Article 3.3 Multiple power banks can be rented simultaneously per account, depending on availability at the hub.

4. Payment and Costs

Article 4.1 For each rental transaction, the User pays variable rental fees, which depend on the location and specific hub where the power bank is rented. The rental fees are paid directly per rental transaction and, upon return of the power bank, calculated based on the rental duration and deducted from the deposit, as described in Article 4.2. The exact rental fees, including any start-up fees and maximum fees per rental period, are transparently displayed in the App/Website before the rental transaction, as described in Article 4.4.

Article 4.2 At the start of a rental transaction, the User is required to pay a refundable deposit, the amount of which varies depending on the location and specific hub. Upon return of the power bank, the rental fees are deducted from the deposit based on the calculated rental duration, and the remaining amount is immediately refunded by ICCXX via the original payment method, with a processing time of up to 48 hours depending on the bank. If the power bank is not returned within 24 hours, the deposit is forfeited as a purchase price, but the power bank remains the property of ICCXX and must be returned to a hub for reuse or recycling, as described in Article 6.

Article 4.3 Payments are processed via Multisafepay, the Payment Provider as defined in Article 1. The User settles each rental transaction directly using one of the following contactless payment methods, without linking a payment method to the account:

  • Apple Pay

  • iDEAL

  • Mastercard

  • Visa

  • Google Pay

  • Sofort

Article 4.4 The variable rental fees, deposit conditions, calculation of rental fees upon return, the refund processing time of up to 48 hours, and the option to choose a payment method per rental transaction are transparently displayed in the App/Website before and during the rental process, as described in Article 3. Upon return, the User receives a rental record in the App/Website with details of the duration, costs, and start and end locations of the rental transaction. Additionally, the User can download an invoice in PDF format for business purposes.

Article 4.5 No additional costs are charged for unreturned power banks after 24 hours, except for the permanent forfeiture of the variable deposit, as described in Article 4.2.

5. Return Policy

Article 5.1 The User can return the power bank to one of ICCXX’s multiple hubs located throughout the Netherlands. An interactive map in the App shows available return locations, including real-time inventory status, location descriptions, and photos, to assist the User in finding a suitable hub. Upon return, the User receives a confirmation notification and a rental record in the App/Website with details of the rental duration, costs, and start and end locations of the rental transaction.

Article 5.2 Upon return of the power bank within 24 hours, the variable rental fees are calculated based on the rental duration and deducted from the variable deposit, as described in Article 4.2. The remaining deposit amount is immediately refunded by ICCXX via the original payment method, with a processing time of up to 48 hours depending on the bank. If returned after 24 hours, the deposit is not refunded, as described in Article 4.2. The User can download an invoice in PDF format via the App/Website for business purposes, as described in Article 4.4.

Article 5.3 If the power bank is not returned within 24 hours, the variable deposit is permanently forfeited as a purchase price, as described in Article 4.2. However, the power bank remains the property of ICCXX and must be returned to a hub for reuse or recycling, in line with ICCXX’s sustainability objectives. ICCXX reserves the right to charge repair costs in case of misuse or damage by the User, up to the maximum amount of the deposit per power bank.

6. User Obligations

Article 6.1 The User is obliged to use the power bank carefully and solely for its intended purpose, namely charging electronic devices. The User must handle the power bank with due care to prevent damage, loss, or unsafe use, in accordance with ICCXX’s safety standards as described in Article 3.

Article 6.2 The User is prohibited from opening, modifying, sabotaging, transferring, selling, or otherwise using the power bank or hub in any manner that violates these Terms or the law. Any unauthorised use may result in repair costs or other liability, as described in Article 5.3.

Article 6.3 The User is obliged to immediately report any defects, damage, or other issues with the power bank to ICCXX via the App, by email to support@iccxx.nl, or by phone at +31854016533. The report must include sufficient details to enable ICCXX to assess the issue and take appropriate measures.

Article 6.4 The User is responsible for returning the power bank to an ICCXX hub, as described in Article 5, regardless of whether the variable deposit has been forfeited after 24 hours, as described in Article 4.2. Failure to return the power bank, even after deposit forfeiture, may lead to additional measures by ICCXX to ensure reuse or recycling, in line with ICCXX’s sustainability objectives.

7. Liability

Article 7.1 ICCXX ensures that the power banks and hubs comply with safety standards, are CE-certified, and made of fire-resistant materials, as described in Article 3. ICCXX is not liable for indirect damages, such as data loss or damage to the User’s devices, unless such damage results from gross negligence or intent by ICCXX. ICCXX’s liability is limited to the amount of the variable deposit.

Article 7.2 The User is liable for damage to the power bank or hub resulting from misuse, negligence, or violation of the obligations as described in Article 6. ICCXX may charge repair costs for such damage, up to the maximum amount of the variable deposit per power bank, as described in Article 5.3. The User is also responsible for returning the power bank, even after deposit forfeiture, as described in Article 5.

Article 7.3 ICCXX is not liable for interruptions in service or damage resulting from force majeure, such as power outages, network failures, or other unforeseen circumstances beyond ICCXX’s control. In case of force majeure, ICCXX will make reasonable efforts to restore services as quickly as possible. The User indemnifies ICCXX against claims from third parties arising from the User’s use of the power bank.

Article 10.3 Upon termination of the rental transaction, the User’s obligation to return the power bank to an ICCXX hub, as described in Articles 5 and 6.4, remains in effect, regardless of deposit forfeiture.

Article 3.1 To execute a rental transaction, the User, after accepting the Terms during account registration, scans a QR code on an ICCXX hub to access the App/Website.

8. Data Protection

Article 8.1 ICCXX collects minimal personal data from the User to facilitate the rental transaction, as described in Article 3. This data includes authentication data, such as that obtained via Apple, Google, or email to generate a unique user ID, rental data, such as the start time, duration, and location of the rental transaction, and payment information, which is processed via the Payment Provider as defined in Article 1. Authentication data is not stored, and no unnecessary data, such as location tracking outside rental transactions, is collected.

Article 8.2 All collected data is securely stored on a cloud server located in the European Union, specifically in Amsterdam, using TLS 1.3 encryption, role-based access controls, and regular security audits. Rental data and payment information are retained for 7 years to comply with Dutch tax legislation, after which the data is anonymised or deleted.

Article 8.3 ICCXX does not share the User’s personal data with third parties, unless the data is anonymized and used for operational insights, such as optimising hub locations. ICCXX complies with the General Data Protection Regulation (GDPR) and ensures that all data processing complies with applicable legislation.

Article 8.4 The User has the right to request access to their collected personal data, request correction or deletion of this data, subject to the legal retention obligation of 7 years for rental data and payment information. Requests regarding data protection can be submitted via email to support@iccxx.nl or by phone at +31854016533. For more information on personal data processing, see our privacy policy at iccxx.nl/privacybeleid. ICCXX will handle such requests within legal timeframes and inform the User of the outcome.

9. Customer Service

Article 9.1 ICCXX provides support in Dutch and optionally in English to assist with questions, issues, or defects related to the rental transaction, as described in Article 3. Support is available via in-app chat, by email to support@iccxx.nl, or by phone at +31854016533. Users can download rental data and emails in PDF format via the App/Website, as described in Article 4.4, and submit feedback via an in-app feedback form.

Article 9.2 ICCXX aims to resolve Users’ questions and issues quickly and effectively, ensuring customer-oriented support for the use of power bank and hub services.

Article 9.3 If the User has a complaint about ICCXX’s services, it can be submitted via the App, by email to support@iccxx.nl, or by phone at +31854016533. ICCXX will handle complaints within 7 working days and inform the User of the outcome and any follow-up steps. For complaints regarding personal data processing, ICCXX refers to the privacy policy at iccxx.nl/privacybeleid, as described in Article 8.4.

10. Termination and Suspension

Article 10.1 The rental transaction, as described in Article 3, ends upon return of the power bank within 24 hours, with the rental fees deducted from the variable deposit and the remaining amount refunded, as described in Article 4.2. If the power bank is not returned within 24 hours, the rental transaction automatically ends after 24 hours, with permanent forfeiture of the variable deposit as a purchase price, as described in Articles 4.2 and 5.3.

Article 10.2 ICCXX reserves the right to suspend future rental transactions of the User if the User fails to comply with the obligations as described in Article 6, such as repeated misuse of the power bank or hub, failure to report defects, or other violations of these Terms. Suspension may be lifted after consultation with ICCXX via customer service, as described in Article 9.

Article 10.3 Upon termination of the rental transaction, the User’s obligation to return the power bank to an ICCXX hub, as described in Articles 5 and 6.4, remains in effect, regardless of deposit forfeiture. The User’s personal data is processed in accordance with Article 8, with rental data and payment information retained for 7 years and then anonymized or deleted, as described in Article 8.2.

Article 10.4 The User can delete their account via the App or by contacting ICCXX via email at support@iccxx.nl or by phone at +31854016533. Upon account deletion, the User’s personal data is processed in accordance with Article 8, with rental data and payment information retained for 7 years in compliance with the legal retention obligation, as described in Article 8.2.

11. Applicable Law and Dispute Resolution

Article 11.1 These Terms and all rental transactions, as described in Article 3, are governed by Dutch law. Any disputes arising from or related to these Terms fall under the exclusive jurisdiction of Dutch legislation.

Article 11.2 ICCXX and the User aim to resolve disputes related to these Terms or rental transactions amicably through ICCXX’s customer service, as described in Article 9. If a dispute cannot be resolved via customer service, it may be submitted to the competent court in Amsterdam.

12. General Provisions

Article 12.2 ICCXX reserves the right to amend these Terms, as described in Article 2.3. Changes are communicated via the App, the Website at iccxx.nl/algemenevoorwaarden, or through in-app notifications. The User is deemed to agree to amended Terms by continuing to use ICCXX’s services after notification of the change.

Article 12.3 If a provision in these Terms is declared invalid or unenforceable, the remaining provisions remain fully in effect. ICCXX and the User will agree on a replacement provision that aligns as closely as possible with the original intent and is legally valid.

Article 12.4 ICCXX is entitled to transfer its rights and obligations under these Terms to a third party, for example, in the case of a merger or acquisition, provided the User is informed. The User may not transfer their rights and obligations under these Terms without ICCXX’s written consent.
